Self-Governance, is and always will be an open and welcoming space for anybody from any background to come together to learn, teach and heal, mentally, emotionally and spiritually. Self-Governance is where we practice together and grow together. Therefore, by accessing our Site, you agree to these Terms of Use and Privacy Policy that govern your use of the Services. The Terms are subject to change at any time. Post any changes coming into effect, your use of the Service is an acknowledgment and acceptance of the changes.

  • Agreement to terms

These terms of use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Self-Governance (“Self-Governance,” “we,” “our,” or “us”) concerning your access to and use of the https://governtheself.com website as well as mobile website or mobile application (each individually a “Site” and collectively the “Sites”). We are registered in Indonesia and have our registered office in Bali. You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these terms of use. If you do not agree with all of these terms of use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Supplemental terms of use or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these terms of use from time to time. We will alert you about any changes by updating the “Effective date” of these terms of use. Please ensure that you check the applicable terms every time you use our Site so that you understand which terms apply. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised terms of use by your continued use of the Site after the date such revised terms of use are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is not tailored to comply with industry-specific regulations (health insurance portability and accountability act (HIPAA), federal information security management act (FISMA), etc., so if your interactions would be subjected to such laws, you may not use this Site. 

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

  • Intellectual property rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “content”) and the trademarks, service marks, and logos contained therein (the “marks”) are owned or controlled by us or licensed to us. The content and the marks are provided on the Site “as is” for your information and personal use only. Except as expressly provided in these terms of use, no part of the Site and no content or marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the content and the marks.

  • User representations

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these terms of use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

  • User Registration

You may be required to register with the Site to join a course or buy a membership. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

  • Product and Services

 

You would be required to create an account and do the payment for the course. The payment would be processed through a third-party service provider either, Stripe, PayPal or Authorize.net. We reserve the right to change the prices to the course at our discretion at any time. Such a change in fee will not affect any bookings made prior to the change in the Effective date of the fee change. 

 

We offer our services in the below main ways:

 

  1. Courses: We offer, courses that run for a period of 6 months. These courses include live-sessions every 2 weeks and with audio, video and written course material which will be accessible during the period of the course and for a month after it is completed.
  2. Programmes: We offer, 14-day and 21-day Programmes. These are short-term courses that have pre-prepared audio and video and written material.
  3. Memberships: We offer, memberships that provide access to both the Courses and the Programmes for the duration of the Membership plan, either monthly, quarterly or yearly.

 

We offer our books for sale through third parties any refund and cancellation would be the responsibility of the third party.


  • Prohibited activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  • Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any content or enforce limitations on the use of the Site and/or the content contained therein.
  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
  • Use any information obtained from the Site in order to harass, abuse, or harm another person.
  • Make improper use of our support services or submit false reports of abuse or misconduct.
  • Use the Site in a manner inconsistent with any applicable laws or regulations.
  • Engage in unauthorized framing of or linking to the Site.
  • Upload or transmit (or attempt to upload or to transmit) viruses, trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site.
  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • Delete the copyright or other proprietary rights notice from any content.
  • Attempt to impersonate another user or person or use the username of another user.
  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you.
  • Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.
  • Copy or adapt the Site’s software, including but not limited to flash, PHP, HTML, JavaScript, or other code.
  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
  • Except as may be the result of a standard search engine or internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
  • Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.
  • Use the Site as part of any effort to compete with us or otherwise use the Site and/or the content for any revenue-generating endeavour or commercial enterprise.


  • User-generated contributions

The Site does not offer users to submit or post content. You may contribute to the site in the form of text or audio, which would be a recording of the class (collectively, “contribution”). Contributions may be viewable by other users of the Site and through third-party websites. As such, any contributions you transmit may be treated in accordance with the Site privacy policy. When you create any contribution, you thereby represent and warrant that:

  • The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
  • You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your contributions in any manner contemplated by the Site and these terms of use.
  • You have the written consent, release, and/or permission of each and every identifiable individual person in your contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your contributions in any manner contemplated by the Site and these terms of use.
  • Your contributions are not false, inaccurate, or misleading.
  • Your contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
  • Your contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libellous, slanderous, or otherwise objectionable (as determined by us).
  • Your contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
  • Your contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
  • Your contributions do not violate any applicable law, regulation, or rule.
  • Your contributions do not violate the privacy or publicity rights of any third party.
  • Your contributions do not otherwise violate, or link to material that violates, any provision of these terms of use, or any applicable law or regulation.

Any use of the Site in violation of the foregoing violates these terms of use and may result in, among other things, termination or suspension of your rights to use the Site.

  • Contribution license

You and the Site agree that we may access, store, process, and use any information and personal data that you provide following the terms of the privacy policy and your choices (including settings).

By submitting suggestions or other feedback regarding the Site, you agree that we can use and share such feedback for any purpose without compensation to you.

We do not assert any ownership over your contributions. You retain full ownership of all of your contributions and any intellectual property rights or other proprietary rights associated with your contributions. We are not liable for any statements or representations in your contributions provided by you in any area on the Site. You are solely responsible for your contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your contributions.

  • Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these submissions for any lawful purpose, commercial or otherwise, without acknowledgement or compensation to you. You hereby waive all moral rights to any such submissions, and you hereby warrant that any such submissions are original with you or that you have the right to submit such submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your submissions.

  • Site management

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these terms of use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these terms of use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

  • Term and Termination

These terms of use shall remain in full force and effect while you use the Site.

You shall have access to the audio files for the duration of the course and for one month past the course completion for you to refer and reflect on the course content.

Without limiting any other provision of these terms of use, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these terms of use or of any applicable law or regulation. We may terminate your use or participation in the Site or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In Addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

  • Modifications and interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these terms of use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

  • Governing Law

These terms shall be governed by and defined following the laws of Indonesia. Self-Governance and yourself irrevocably consent that the courts of Indonesia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

  • Dispute resolution

You agree to irrevocably submit all disputes related to terms or the relationship established by this agreement to the jurisdiction of the Indonesian courts. Self-Governance shall also maintain the right to bring proceedings as to the substance of the matter in the courts of the country where you reside or, if these terms are entered into in the course of your trade or profession, the state of your principal place of business.

  • Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

  • Disclaimer

The Site is provided on an as-is and as-available basis. You agree that your use of the Site and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to the Site and we will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the Site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or Otherwise made available via the Site. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and we will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

  • Limitations of liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising. Certain us state laws and international laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.

  • Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and Employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these terms of use; (3) any breach of your representations and warranties set forth in these terms of use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

  • User data

We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

  • Electronic communications, transactions, and signatures

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures, contracts, orders, and other records, and to the electronic delivery of notices, policies, and records of transactions initiated or completed by us or via the Site. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

  • Miscellaneous

These terms of use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these terms of use shall not operate as a waiver of such right or provision. These terms of use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these terms of use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these terms of use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these terms of use or use of the Site. You agree that these terms of use will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these terms of use and the lack of signing by the parties hereto to execute these terms of use.

Self-Governance emphasizes and engages in general educational well-being content and advice. We are not tailored to provide psychological interventions aimed at curing psychological illnesses. We expect you to use our products, services and content within the boundaries of your professional expertise and at your own risk. All advice Self-Governance provides is ‘advice only’ that should only be used/distributed within the bounds of your expertise. Self-Governance does not guarantee any specific outcomes, measurable effect in relation to any exercise, or meditation aimed at improving well-being suggested by us alongside the course of work delivered. Self-Governance has no liability for any consequence of any action taken by the user relying on the basis of any content delivered or any information provided on this Site. You must seek independent psychological and medical advice for any psychological and medical issue faced. Any specific information provided by Self-Governance on any of your requests and any information obtained or materials downloaded from our website is completely out of your own volition and any transmission, receipt, or use of this Site does not create any client relationship between you and us. 

If Self-Governance receives notice that Content posted is unlawful or not in keeping with the Terms or the intended use of the Site, we reserve the right to remove the material. 

To file a notice of infringement with us, you must provide a written communication (by email with an attached and signed PDF) that sets forth the items specified below. We will ideally reply within a span of 2-3 working days. To enable us to address your concerns, please provide the following information: 

For each allegedly infringing image, or piece of text that you wish to have removed from one of our sites, provide the exact permanent URL for the page containing the material.

Provide information reasonably sufficient to permit us to contact you: an email address is preferred, as well as a telephone contact number.

For images, provide the following information detailing your claim to ownership of the copyright in the allegedly infringing image, or piece of text: Proof of copyright in the image, or piece of text concerned, namely proof of registration; OR, absent such registration, a detailed description, and evidence to support your claim that you own the copyright in the image, or piece of text. Self-Governance Privacy Policy

This Privacy Policy describes how Self-Governance (“Self-Governance,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes personal information about you related to your access or use of https://governtheself.com/, and other site or applications, including mobile applications, used or operated by Self-Governance (each individually a “Site” and collectively the “Sites”). Self-Governance does not intend to collect any personal information from children under 16 unless such collection is permitted by law. Your use of the Site, including any dispute concerning privacy, is subject to this Privacy Policy and Self-Governance’s Terms and Conditions of Use and any other policies on the applicable Site (collectively the “Terms”). We reserve the right to modify this Privacy Policy at any time. If we make changes to this policy, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification).

Any information that is received by Self-Governance from such websites shall be treated in accordance with this Privacy Policy.

  1. WHAT INFORMATION IS COLLECTED?

Our Site collects various information about you, including information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. In particular, the Site will collect the following categories of information:

Self-Governance does not collect information that consists of:

  1. Protected classification characteristics such as race, colour, ancestry, national origin, or similar immutable characteristics.
  2. Biometric information such as genetic, physiological, behavioral, and biological characteristics.
  3. Professional or employment-related information from consumers other than applicants, employees, business owners, directors, officers, medical staff, or contractors of Self-Governance.
  4. Non-public education information.

Self-Governance obtains the categories of information listed in the table above from the following categories of sources:

  1. Directly from you. For example, from forms you complete or products and services you purchase.
  2. Indirectly from you. For example, from observing your actions on our Site.

Please note that your personal information does not include (A) publicly available information from government records or (B) deidentified or aggregated consumer information.

  • HOW IS MY INFORMATION COLLECTED?

We collect certain information when you register or provide us your information on the Site. We may ask you to register and/or provide information when you visit certain areas of our Site, register for services, subscribe to a newsletter, or other communication.

  1. HOW IS MY INFORMATION USED BY SELF-GOVERNANCE?

Self-Governance may use or disclose the information we collect for one or more of the following purposes:

  1. To fulfill or meet the reason you provided the information. For example, if you share your name and contact information or ask a question about our products or services, we will use that information to respond to your inquiry. If you provide your information to purchase a service, we will use that information to process your payment. We may also save your information to facilitate new product orders;
  2. To process purchases, transactions, and payments;
  3. To attempt to detect and reduce fraud, credit risk, and other illegal activities or threats to the safety, security, or integrity of the Site;
  4. To provide, support, personalize, and develop our Site, products, and services;
  5. To personalize your experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Site, third-party site, and via email or text message (with your consent, where required by law);
  6. To provide a seamless experience across multiple devices, platforms or browsers for each user;
  7. To create, maintain, customize, and secure your account with us;
  8. To offer special contests or promotions that are sponsored by Self-Governance or another company;
  9. To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
  10. To fulfil or complete any other purpose or function described to you when collecting your information.
  • WHO DOES SELF-GOVERNANCE SHARE INFORMATION WITH?

Subject to applicable law, we share your information with our affiliates, vendors and employees for business purposes. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. For example, we may share your personal information or other data (A) with third parties assisting us in the provision, administration, and management of goods and services generally; (B) with third parties that assist us in providing goods and services that you request; (C) with third parties that support our business operations or provide marketing or advertising services on our behalf, including marketing, technical, accounting, legal or other professionals. We may use your information for our general business operations and goods and services provided by us if it is in a form that is not capable of being personally identified with you (including hashed email addresses as described below or other persistent identifiers) or if it is combined with information from one or more other customers in aggregate form that does not personally identify any particular customer.  

As we develop our business, we may buy or sell assets, and, depending upon the transaction, your information may be one of the transferred assets. In the event that Self-Governance or any Site is acquired by another company, your information may be part of the assets transferred to the acquiring party.

We will not discriminate against you for exercising any of the rights provided below.

Promotional Communications Opt-Out

We may email you with information about other products and services of Self-Governance, including information about selected third parties. If you do not want to receive such promotional communications from Self-Governance, you may decline to receive those email messages by opting out when you receive such a communication, sign-up, register, or from within your account, as applicable. However, we may still communicate with you by email if such email communication is for the purpose of corresponding with you regarding products or services you have requested, related to protecting your interests, including any information, property, or other data, or to provide you with any notification or disclosure that may be required by applicable law or this Privacy Policy. Accordingly, you agree that all communications, disclosures, and notices sent to you by email satisfy any requirement that notice be provided in writing.

Location Sharing Opt-Out

You may opt-out of allowing us to have any access to your precise location data by disabling your device’s location detection functionality or GPS or, if possible, on your device, disabling permission for our Site to access such location detection functionality or GPS.

Access to Specific Information and Data Portability Rights

If you are a California resident, you may request that Self-Governance disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will, to the extent required by applicable law, disclose specific information about what information we have collected, the sources we collected information from, our business purpose in collecting information, who we shared information with, the specific pieces of information we collected about you (also called a data portability request), and any sales or disclosures for a business purpose of your information.

Deletion Request Rights

If you are a California resident, you may request that Self-Governance delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is permitted under applicable law. You should also be aware that deleting certain information may impact your ability to receive certain services from Self-Governance including newsletters, accounts, subscriptions, etc.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above as permitted under state law, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12 (twelve) month period. The verifiable consumer request must: (A) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (B) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Response Timing and Format

We endeavour to respond to a verifiable consumer request at the earliest. If we require more time, we will inform you of the reason and extension period in writing. If applicable, any disclosures we provide will only cover the 12 (twelve) month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.  We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

  1. STORAGE AND TRANSFER OF INFORMATION 

The Site is based in Indonesia and is directed to residents across the world, and we process and store information in Indonesia. If you are located outside Indonesia, we and our service providers may transfer your information to, or store or access your information in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction.

Personal Identifiable information would be stored in our system as, as long as the business requires or to satisfy our contractual requirements, and legal obligations.

  1. SELF-GOVERNANCE’S DATA SECURITY DISCLAIMER.

We do not provide any guarantee or warranty by us that your information will not be accessed or compromised by third parties, or that we will use all available security technologies to prevent unauthorized access to, use, or disclosure of your personally identifying information; or that your information will be transmitted without unauthorized interception or modification. We may permanently delete or destroy any and all information at any time as determined by us.

  1. EUROPEAN UNION / GENERAL DATA PROTECTION REGULATION (“GDPR”)

If you are located within the European Economic Area (“EEA”) or within another jurisdiction having similar data protection laws to the GDPR, Self-Governance provides such users with the following rights:

  1. the right to be told how we use your information and with access to your information;
  2. the right to have your information rectified or erased or to place restrictions on processing your information;
  3. the right to object to the processing of your information (e.g., for direct marketing purposes);
  4. the right to have information you directly provided to us provided to you in a structured, commonly used, and machine-readable format;
  5. wherein the processing of your information is based on your consent, the right to withdraw that consent subject to legal or contractual restrictions;
  6. the right to object to any decisions that have significant legal effect based on the automated processing of your information, including profiling; and
  7. the right to lodge a complaint with the supervisory authority responsible for data protection matters.

If we hold any information about you that is incorrect, or if there are any changes to your details, please let us know so that we can keep our records accurate and up-to-date. If you withdraw your consent to the use of your information for purposes set out in our Privacy Policy, we may not be able to provide you with access to all or parts of the Site. We will retain your information for the duration of our business relationship and afterward for as long as is necessary and relevant for our legitimate business purposes, in accordance with our data retention, marking and destruction policy, or as otherwise permitted by applicable laws and regulations.

Certain data protection law requires us to rely on one or more lawful grounds to process your personal information. We consider the following grounds to be relevant:

  1. Consent: Wherein you have provided consent in accordance with applicable law to us using your personal information in a certain way, such as to send you email, text, and/or telephone marketing.
  2. Performance of a contract: Wherein we are entering into a contract with you or performing our obligations under it, such as when you buy products and services through the Site.
  3. Legal obligation: Where necessary so that we can comply with a legal or regulatory obligation to which we are subject, for example where we are ordered by a court or regulatory authority.
  4. Legitimate interests: Wherein it is reasonably necessary to achieve our or others’ legitimate interests (as long as what the information is used for is fair and does not unduly impact your rights). We consider our legitimate interests to be operating the Site and facilitating the services we provide to users. For example, to:
  1. understand how people choose/use our services and products;
  2. determine the effectiveness of our services, promotional campaigns, and advertising;
  3. monitor whom we deal with to protect against fraud, money laundering, and other risks;
  4. enhance, modify, personalize, or otherwise improve our services/communications for the benefit of our customers; and
  5. better understand how people interact with the Site.

When we process your personal information in this way, we consider and balance any potential impact on you (both positive and negative) and your rights under data protection laws. We will not use your personal information where our interests are overridden by the impact on you.

Due to the nature and location of our business in Indonesia, your personal data will be disclosed to Self-Governance and others as outlined herein outside of the EEA. It may also be processed by our employees or suppliers operating outside the EEA.

If you are in the EEA, we provide adequate protection for the transfer of your personal data to countries outside of the EEA through a series of intercompany agreements based on the Standard Contractual Clauses authorized under EU law or equivalent measures.
